Statement by India under Agenda Item 3: Interactive Dialogue with the Working Group on Arbitrary Detention at the 60th Session of the Human Rights Council (8 September - 8 October 2025), Permanent Mission of India,

Mr. President,

1. We have taken note of the report of the Working Group on Arbitrary Detention.

2. India remains firmly committed to the promotion and protection of human rights of all its people. As the world’s largest democracy, founded on the principles of rule of law, equality before law, and respect for fundamental freedoms, we have in place strong constitutional guarantees and institutional safeguards to protect individuals against arbitrary arrest or detention.

3. Our Constitution ensures the right to life and personal liberty and lays down safeguards in criminal law. These include the right to legal counsel, the right to be informed of the grounds of arrest, production before a magistrate within 24 hours, and the prohibition of detention beyond this period except under judicial authority. In addition, our proactive and independent judiciary, a strong National Human Rights Commission, and other statutory commissions safeguard the rights of vulnerable groups.

4. India will continue to engage constructively with the Working Group on Arbitrary Detention and provide relevant information in accordance with our obligations.
