Statement by India under Agenda Item 3: Interactive Dialogue with the Working Group on Enforced and Involuntary Disappearances at the 60th Session of the Human Rights Council (8 September - 8 October 2025,

Mr. President,

1. We have taken note of the report of the Working Group on Enforced and Involuntary Disappearances.

2. India is a vibrant democracy anchored in rule of law, equality before law, and respect for human rights. Our Constitution guarantees the right to life and liberty, while our independent judiciary, empowered to issue writs of habeas corpus, acts as a strong safeguard against any alleged disappearance. The National Human Rights Commission and other statutory bodies also provide effective avenues of redress.

3. The law enforcement authorities in India are fully bound to act within the framework of law. There is no concept of absolute immunity for any individual, including security forces. Courts and quasi-judicial bodies have granted remedies, including compensation and disciplinary measures, wherever warranted. Transparency and accountability are further advanced through the Right to Information Act.

4. India remains committed to engaging constructively with the Working Group and providing it with the necessary information, as available and appropriate.
